Lawyers in Legal Services Branch at the Edmonton Police Service act as legal counsel for all police officers and civilian members in respect of civil legal matters arising because of their duties.

If you are counsel on a civil matter where the Chief of Police or officers of the EPS are named as Defendants or Respondents, you should direct all communication intended for an EPS employee on a legal matter through Legal Services Branch as follows at Public.Legal@edmontonpolice.ca.

Alberta Lawyers should refer to rule 7.2-8 of the Law Society of Alberta’s Code of Conduct before attempting to approach, communicate, or deal with EPS employees on a civil matter related to the performance of their duties.


I need to speak with a lawyer from EPS by phone

If you or your lawyer need to speak with a lawyer representing the Chief, an employee, or a police officer at the EPS, send an email to Public.Legal@edmontonpolice.ca. Include the reason you need to speak with one of our lawyers.

Lawyers with Legal Services Branch do not represent you or your interests. You must retain your own lawyer to do that. Lawyers with Legal Services Branch represent the Chief of Police, employees, and police officers of the EPS.

I need to serve legal documents on the Chief of Police

1. Start by contacting Legal Services Branch by email at Public.Legal@edmontonpolice.ca. Please note that this address is for arranging service, and not for service of any legal documents.

 

2. A lawyer will be in touch to arrange for service during regular business hours, either electronically or in person at Police Headquarters at 9620 103A Avenue NW.

I have emailed the documents I want to serve. Do I still need to arrange for service?

Yes. The Chief, EPS, and EPS police officers and employees will not accept electronic service without planning it with you. Electronic service is usually possible, but only once a lawyer has been assigned and can accept service.

This is especially important with documents that trigger deadlines by their service, or in the rare circumstance where the service of hard copies would be preferred.

I need to serve legal documents on a police officer or other employee of EPS

1.Contact Public.Legal@edmontonpolice.ca at least one week before your service deadline.

2. A lawyer with Legal Services Branch needs to obtain instructions to accept service on that employee’s behalf. This can sometimes take time due to the nature of the employee’s shift work, vacation, etc.

3. In most cases, electronic service can be accommodated. If electronic service is not appropriate for some reason, a lawyer or paralegal with Legal Services Branch will be in touch to arrange for service in person at Police Headquarters at 9620 103A Avenue NW.

I need to make a third-party record application under rule 5.13 of the Alberta Rules of Court

1. To obtain EPS records pursuant to rule 5.13 of the Alberta Rules of Court, counsel must provide notice to Legal Services Branch by Public.Legal@edmontonpolice.ca before an application is made or set down in Chambers.

 

2. Notice can be made by contacting Legal Services Branch at Public.Legal@edmontonpolice.ca. In your email, please provide the EPS file number you are concerned with, and a copy of the pleadings for your matter.

 

3. We will obtain the records, review them, and advise you of any statutory or common-law objections to disclosure, along with the applicable administrative fees. Most of the time there are few, if any, objections to disclosure. Any objections can usually be dealt with by agreeing to certain redactions (e.g., redacting privileged or confidential information).

 

4. Once we advise you of our position on your application, you will be free to make your application. We will usually be able to either consent to your application or take no position and not appear in Court with you on an undertaking that you ensure our objections are reflected in the final form of order.

 

As rule 5.13 applications are not urgent, please allow up to 3 months from your first notice. If you require information more urgently, please advise of the reasons that this request is urgent.

I need to make a third-party record application for a criminal matter, such as an O’Connor or Mills application.

Please contact Public.Legal@edmontonpolice.ca if you are making an O’Connor or Mills application in a matter that is before the courts. A lawyer from Legal Services Branch will assist you. In your email, please clearly advise of any upcoming court dates or exigencies.

While we do make every effort to treat these applications with the urgency they deserve, reasonable notice is required.

DO NOT assume that notice to the Crown of a third-party application is sufficient for the Edmonton Police Service to attend and respond. It is not.

I want to make an application under the Freedom of Information and Protection of Privacy Act.

Applications under the Freedom of Information and Protection of Privacy Act are handled by the Edmonton Police Service FOIPP Unit, and not Legal Services Branch. To make an application under that Act, see FOIPP website.

I represent a tribunal, commission, inquiry, or other entity, and need to speak with counsel for the Chief of Police or an employee of the Edmonton Police Service
